S.R. Raju vs State of Karnataka Thr. SHO and another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

S.R. Raju was convicted under Section 324 IPC for causing simple injuries with an iron rod during an assault that occurred on 09.09.2005. The trial court sentenced him to one year rigorous imprisonment and a fine of Rs. 500. The High Court modified the sentence to one month simple imprisonment and Rs. 25,000 fine. On appeal, the Supreme Court found that Section 324 CrPC became compoundable only after a 2009 amendment, and therefore was not compoundable at the time of the 2005 incident. Since the parties had compromised and maintained good relations, the Court set aside the High Court's order and allowed the appeal, compounding the offence.
