Sourabh Brala & Ors vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A private medical college (Subharti) in Uttarakhand faced closure after the State Government attempted takeover but failed to secure affiliation from the state's medical university. The Supreme Court directed the State to return the college to its former management within one week. To protect 300 enrolled students (150 first-year, 150 second-year), the Court ordered they be accommodated in other government and private medical colleges with temporary ad hoc seats. Displaced students must pass examinations at their new institutions before progression. Staff salary arrears go to the former management; future salaries to the State. A committee was directed to decide future employment of the original staff within three weeks."
