A medical college sought permission to establish and admit MBBS students. Conditional permission was granted for 2016-17, but successive inspections revealed persistent deficiencies in faculty, residents, clinical facilities, and patient intake. The college failed to cure these defects despite opportunities. The government debarred it from fresh admissions for two years and authorized encashment of its bank guarantee. The Supreme Court held that while students already admitted must be allowed to complete their studies, the college was not entitled to confirmation for 2017-18. However, the bank guarantee would not be encashed. The college could apply afresh for 2018-19 following a new inspection and compliance verification under the statutory procedure."
