Supreme Court of India 2016-06-29 remanded

Surendra Kumar Gupta and Ors vs State of U.P. and Anr

Bench: 2 — Kurian

In Brief

The appellants challenged a High Court decision that rejected their argument that land acquisition proceedings had lapsed under Section 24(2) of the 2013 Land Acquisition Act. The High Court dismissed the argument as belated. The Supreme Court held that this was an error, since the Act came into force only on 01.01.2014 and the contention could only be advanced thereafter. The Court set aside the High Court's judgment and remitted the matter for substantive consideration of whether the proceedings had indeed lapsed under the statutory provision, directing expedited disposal.
