Supreme Court of India 2016-06-29 remanded

Surendra Kumar Gupta and Ors vs State of U.P. and Anr

Bench: 2 — Kurian

In Brief

The appellants challenged a High Court order declining to consider whether land acquisition proceedings had lapsed under Section 24(2) of the 2013 Land Acquisition Act. The High Court had rejected the contention as belated. The Supreme Court held that such a contention could only be raised after the Act came into force on 1 January 2014, so it could not be dismissed as tardy. The Court set aside the High Court's judgment and remitted the matter for proper consideration of whether the acquisition proceedings had actually lapsed under the Act.
