Association of Managements of Homeopathic Medical Colleges of Maharashtra vs Union of India & Ors

Bench: 2 — L. Nageswara Rao

In Brief

Medical college associations challenged the mid-process change in BHMS admission eligibility criteria from the original standard (qualifying in 10+2 with Physics, Chemistry, Biology) to requiring a 50th percentile score in NEET. The government issued the new requirement on 11 June 2018, after the NEET exam and during registration. The Supreme Court held that admissions must proceed under the original February 2018 criteria stated in the information brochure. The Court noted that other High Courts nationwide had granted similar relief and that enforcing the new standard would leave many seats vacant and disadvantage eligible students. The Court allowed the appeals, permitting admissions based on the original brochure and directing colleges to conduct extra classes to meet curriculum requirements.
