Delhi Development Authority vs Kram Singh @ Bikram Singh @ Jagdish and Ors

Bench: 2 — Kurian

In Brief

The Delhi Development Authority challenged the dismissal of land acquisition proceedings under the 2013 Land Acquisition Act. The Supreme Court found that the legal issue was already settled by earlier judgments and dismissed the appeal. However, recognizing the peculiar circumstances, the Court granted the Authority one year to initiate fresh acquisition proceedings by issuing a statutory notification. If the Authority fails to do so within this period, it must return possession of the land to the original owner. The appeal was dismissed without costs, but with this conditional opportunity for re-initiation.
