The Government of NCT of Delhi appealed against the dismissal of a land acquisition proceeding initiated under the RFCTLARR Act, 2013. The Supreme Court dismissed the appeal, holding that it was covered by binding precedent (Civil Appeals Nos. 8477 of 2016 and 5811 of 2015). The Court granted the requisitioning authority one year from the judgment date to reinitiate fresh acquisition proceedings by issuing a Section 11 notification. Failure to do so within that period would require the authority to return possession of the land to its original owner, and all pending applications would stand disposed of.
