In Brief
Delhi Development Authority challenged a decision rejecting its land acquisition proceedings under the RFCTLARR Act, 2013. The Supreme Court dismissed the appeal as being covered by prior precedent on Section 24(2), which deals with reinitiation of abandoned acquisitions. However, exercising discretion in the peculiar circumstances, the Court granted the Authority until 31 December 2017 to initiate fresh acquisition proceedings by issuing formal notification. If not initiated within this period, the Authority must return physical possession to the original landowner.
