Government of NCT of Delhi and Anr vs Satish Kumar Aggarwal and Ors

Bench: 2 — Kurian

In Brief

The Supreme Court dismissed consolidated civil appeals filed by the Government of NCT of Delhi and the Delhi Development Authority challenging orders in land acquisition proceedings. The Court held that the main issue was already decided against the appellant in a prior Supreme Court judgment. While dismissing the appeals, the Court granted the appellant a one-year period to initiate fresh land acquisition proceedings under the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013. If fresh proceedings are not initiated within this period and the appellant remains in possession, it must return the land to the original owner.
